Terms of Service

ArabeToDe ("we", "us", "our") is an AI-powered educational platform designed to help Arabic speakers learn the German language. The platform is available at arabetode.app and provides the following modules:

• Individual Learning: Vocabulary, AI Tutor, reading practice, games, structured learning path, CV builder, placement tests.
• Academy: A marketplace of paid and free courses taught by approved instructors, with certificates of completion.
• Language Exchange: Live video/audio sessions between learners for language practice.
• Language Centers (SaaS): A multi-tenant management platform for language schools and institutions, including teacher and student dashboards, placement tests, and exercise management.
• Chancenkarte Tools: Resources and guidance for the German opportunity card (Chancenkarte) immigration process.

2.1 Registration. To access most features, you must create an account using a valid email address (with verification) or Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials.

2.2 Accurate Information. You agree to provide accurate, current, and complete information and to keep it updated. Providing false information may result in account termination.

2.3 Age Requirement. You must be at least 16 years old to create an account. Users aged 16–17 must have parental or guardian consent. By creating an account, you confirm you meet this requirement.

2.4 Account Security. You are responsible for all activity that occurs under your account. Notify us immediately at support@arabetode.app if you suspect unauthorised access.

2.5 Profile Completion. Some features require a completed profile (phone number, country, and education center affiliation). You will be prompted to complete your profile before accessing these features.

2.6 One Account Per Person. Creating multiple accounts to circumvent restrictions, free trial limits, or platform rules is prohibited.

3.1 Free Plan. ArabeToDe offers a free tier with access to a defined set of features. Free plan limits are subject to change with reasonable notice.

3.2 Paid Subscriptions. Premium subscription plans (monthly or annual) unlock additional features including ad-free learning, AI study plans, the CV builder, language exchange calls, and more. Feature availability per plan is displayed on the Pricing page.

3.3 Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will receive a reminder email before annual renewals.

3.4 Price Changes. We may change subscription prices. We will give at least 30 days' notice before any price increase takes effect for existing subscribers. You may cancel before the new price applies.

3.5 Free Trials. Where offered, free trials are available to new subscribers only. At the end of the trial, your chosen plan will begin and you will be billed. Cancel before the trial ends to avoid charges.

4.1 Course Purchases. Individual courses in the ArabeToDe Academy may be purchased as one-time transactions. Purchase grants a non-exclusive, non-transferable licence to access the course content for the lifetime of your account and as long as the course remains on the platform.

4.2 Course Access. Course access begins immediately upon successful payment. You may start, pause, and resume courses at your own pace.

4.3 Certificates. Upon completing a course (meeting all progress requirements), a certificate of completion will be issued. Certificates are verifiable at arabetode.app/verify-certificate. Certificates are non-transferable and tied to your account.

4.4 Course Availability. While we intend to keep courses available indefinitely, instructors may remove their courses from the catalogue. We cannot guarantee permanent availability of specific course content.

6.1 Payment Processors. We use Paddle.com as our primary Merchant of Record for subscriptions and course purchases. PayPal and bank transfer options may be available for certain regions. Your payment is processed securely by these providers; we do not store full payment card data.

6.2 Currency & Taxes. Prices are displayed in your local currency where possible. Applicable taxes (VAT, GST, etc.) may be added at checkout depending on your location. Paddle collects and remits applicable taxes as Merchant of Record.

6.3 Failed Payments. If a payment fails, we will attempt to notify you and may suspend access to premium features until the payment is resolved.

7.1 AI Tutor. The AI Tutor ("Gemini Tutor") is powered by Google Gemini and is designed exclusively as a German language learning tool for Arabic speakers. It provides grammar explanations, error correction, vocabulary assistance, and conversation practice.

7.2 No Professional Advice. The AI Tutor does not provide legal, medical, financial, immigration, or any other professional advice. Any information provided by the AI is for educational and language learning purposes only and should not be relied upon as professional guidance.

7.3 AI Limitations. AI-generated content may contain errors, inaccuracies, or outdated information. We make no warranty that AI outputs are accurate, complete, or suitable for any particular purpose. Always verify important information from authoritative sources.

7.4 AI Content Ownership. AI-generated content produced through your interaction with the platform's AI features may be used to improve platform services. You retain the right to use AI-generated content for your personal educational use.

7.5 Prohibited AI Use. Do not use AI features to generate harmful, illegal, or offensive content. See our Acceptable Use Policy for full AI restrictions.

8.1 Center Administrators. Language Center administrators ("Center Admins") are responsible for managing their center's subscription, adding students and teachers, and ensuring compliance with these Terms within their center.

8.2 Student & Teacher Accounts. Center Admins may create student and teacher accounts within their center. They are responsible for obtaining appropriate consent from these users and ensuring compliance with applicable data protection laws (including GDPR where applicable).

8.3 Center Data. Student progress data, exercise results, and placement test scores are visible to the center's administrators and teachers. Students may request their data from their center administrator or directly from us.

8.4 Center Plan Billing. Language Center subscriptions are billed on a monthly or annual basis per the plan selected at registration. Centers are subject to the same refund policy as individual users.

8.5 Center Subdomain. Registered centers may receive a custom subdomain (e.g., centername.arabetode.app). ArabeToDe reserves the right to revoke subdomain access if the center violates these Terms.

If you apply to become an instructor on the ArabeToDe Academy, your relationship with us is governed by the Instructor Agreement, which supplements these Terms. In the event of a conflict, the Instructor Agreement takes precedence for instructor-specific matters.

10.1 Platform Content. All platform content created by ArabeToDe — including the software, design, vocabulary databases, reading texts, game content, structured learning materials, Chancenkarte tools, and branding — is owned by or licensed to ArabeToDe and protected by copyright and other intellectual property laws.

10.2 Licence to Users. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the platform content for your own educational, non-commercial purposes. This licence does not include the right to reproduce, distribute, create derivative works from, or commercially exploit any platform content.

10.3 User Content. You retain ownership of content you create or upload (e.g., CV Builder documents, custom pages submitted through centre tools). By submitting content to the platform, you grant ArabeToDe a licence to host and display it as necessary to provide the service.

10.4 Feedback. If you submit suggestions, feedback, or ideas to us, you grant ArabeToDe a royalty-free, worldwide, perpetual licence to use that feedback for any purpose without compensation to you.

You agree not to engage in any conduct that violates our Acceptable Use Policy, which forms part of these Terms. Key prohibitions include (but are not limited to):

• Circumventing access controls, paywalls, or security measures.
• Reverse engineering, decompiling, or attempting to extract the platform's source code.
• Scraping or harvesting data from the platform without authorisation.
• Using the platform to engage in harassment, discrimination, or illegal activity.
• Misusing AI features to generate harmful content.
• Creating fake accounts or manipulating platform metrics.

12.1 By You. You may delete your account at any time through your Profile settings. Upon deletion, your personal data will be removed within 30 days, subject to legal retention requirements. Note the refund policy in Section 5 regarding any active subscriptions at the time of deletion.

12.2 By ArabeToDe. We may suspend or permanently terminate your account, with or without prior notice, if you:

• Violate these Terms or our Acceptable Use Policy.
• Engage in fraudulent, abusive, or illegal behaviour.
• Fail to pay amounts due (subscription fees).
• Provide materially false registration information.

12.3 Effect of Termination. Upon termination, your licence to use the platform ceases. Sections 10, 13, 14, and 15 survive termination.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The platform will be uninterrupted, error-free, or secure at all times.
• AI-generated content will be accurate, complete, or up to date.
• Learning outcomes (e.g., CEFR level achievement, exam pass rates) will be guaranteed.
• The platform will be free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARABETODE AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

In no event shall ArabeToDe's total liability to you for all claims arising from or related to the platform exceed the greater of: (a) the amounts you paid to ArabeToDe in the 12 months preceding the claim, or (b) €50 / £50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection law in your country of residence provides otherwise.

EU consumers may also refer disputes to the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the change takes effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, Acceptable Use Policy, and (where applicable) the Instructor Agreement, constitute the entire agreement between you and ArabeToDe regarding the platform.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

No Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Language. These Terms are available in English, Arabic, German, and French. The English version is authoritative. In-app language versions are provided for convenience only.
